1. ACCEPTANCE OF THESE TERMS

These terms and conditions govern your use of the Northwind Marine website and any order you place through it. By placing an order you confirm that you accept these terms. Northwind Marine, Inc. may revise these terms from time to time; the version in force at the moment you place an order is the version that applies to that order. If you do not accept these terms, please do not use the site to place orders.

2. WHO YOU ARE CONTRACTING WITH

Parts, accessories and provisions ordered through this site are supplied by Northwind Marine, Inc., 850 Bayfront Parkway, Pensacola, FL 32502. Boats are not sold through this site. Every Northwind hull is sold, commissioned and handed over by an authorised Northwind dealer, and your contract for a boat is with that dealer. Quotes, sea trials and build slots arranged through this site are offers to introduce you to a dealer, not offers of sale by us.

3. ORDERS, PRICING AND AVAILABILITY

All prices are shown in US dollars and exclude applicable sales tax unless stated otherwise. Dealer and trade accounts see their contracted net pricing once signed in. We take reasonable care to price and describe every item correctly, but where an item has been listed at a manifestly incorrect price we may decline or cancel the order and refund you in full rather than supply at that price. Stock figures are indicative; where an item is unavailable we will tell you and offer a lead time, an alternative, or a refund.

4. FITMENT AND SUITABILITY

The fitment data, exploded views and hull-identification search on this site are provided to help you find the right part, and are accurate to the best of our knowledge for the model years shown. They are guidance, not a warranty of suitability. Where a part is safety-critical - steering, fuel, propulsion, electrical distribution or gas - we ask that fitment be confirmed and the work carried out by an authorised dealer or a qualified marine technician. We are not liable for loss arising from a part fitted contrary to this clause.

5. DELIVERY

Delivery timescales quoted at checkout are estimates. Risk in the goods passes to you on delivery. Bulky and hazardous items - including propellers, tanks, batteries and pyrotechnic safety equipment - may travel by freight under separate arrangements and may be restricted by destination. Where delivery is made free to a dealer for counter collection, the goods remain our responsibility until you collect them.

6. RETURNS AND CANCELLATION

Unused parts and accessories in original packaging may be returned within 90 days against the order number, using a returns authorisation obtained from your account. Electrical components, charts, and safety equipment carrying a service life are not returnable once opened or fitted. Special-order and custom items are not returnable. Nothing in this clause affects your statutory rights.

7. WARRANTY

Parts supplied by us carry the manufacturer's warranty applicable to that part. Northwind hulls carry the structural and systems warranties set out in the owner's handbook supplied with the boat, administered by your dealer. Warranty cover excludes wear items, damage from grounding, freezing, misuse or missed scheduled service, and any failure attributable to parts or work not carried out to the specified standard.

8. LIMITATION OF LIABILITY

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability arising from any order is limited to the amount paid for that order, and we are not liable for indirect or consequential loss, including loss of use of a vessel, loss of a charter or booking, mooring or storage costs, or recovery and haul-out costs.

9. ACCOUNTS AND ACCEPTABLE USE

You are responsible for keeping your account credentials secure and for orders placed under your account. Trade and dealer accounts must not be shared beyond the named business. You may not use this site to scrape catalogue or pricing data, to interfere with its operation, or to place orders you do not intend to pay for.

10. PRIVACY

Personal data is handled as described in our Privacy Policy, which forms part of these terms.

11. GOVERNING LAW

These terms are governed by the laws of the State of Florida, and the courts of Escambia County, Florida have jurisdiction over any dispute arising from them.
